Hâkimin Adaletsizliği Görmesi Üzerine Bir İnceleme: Evans v Birleşik Krallık

Avrupa İnsan Hakları Mahkemesi’nin Evans v Birleşik Krallık davası, soyut hukuk kurallarının somut olay adaletini sağlamada zayıf kaldığı ve bu anlamda hâkimlerin yorumunun büyük önem taşıdığı bir örnektir. Bu makalede Evans v Birleşik Krallık davası temelinde hâkimin somut olayı ve olaydaki kişilerin durumunu görmesi üzerine bir değerlendirme yapılmaktadır. Değerlendirme ihtimam etiği ve ilişkisel özerklik teorisi ve Gülriz Uygur’un “adaletsizliği görmek” yaklaşımını temel alarak yapılmıştır.
